What do you mean by, TOS? Whatever you might be thinking I'm pretty sure that you are describing EULA, and not, TOS. Think about it for a while. Have you confused these two acronyms?

Maybe things got confused because Autodesk was being discussed, which can be software with accompanying books, which Maverick said according to their TOS, your LICENSE was only for a single original user, thereby preventing you from selling what you may have bought on the secondary market. I think the EULA and TOS are going hand in hand.
